Effective Date: September 24, 2025
Definitions:
- Own + Access: One-time purchase of all high-resolution digital images from your gallery plus one (1) year of hosted gallery access.
- Annual Gallery Storage (“Storage”): Hosts your existing gallery online for twelve (12) months; renews annually unless canceled.
1) Secure Payment
- All transactions are processed by PayPal. We do not store your payment information.
2) Billing & Renewal (Storage)
- Storage is billed once per year and auto-renews on the anniversary of your purchase (America/St. Thomas).
- No prorated refunds for partial terms. Cancel before renewal to avoid the next charge.
3) Post-Promotion Pricing
- After October 31, 2025, Storage returns to the standard annual price (equivalent to $12/month, billed annually).
4) Failed Renewals
- If auto-renew payment fails, we will notify you. If payment details are not updated within 5 days, your gallery is removed on day 6. Reactivation or recovery may not be possible and, if available, follows current pricing.
5) Fulfillment & Delivery
- Download links (for Own + Access) or Storage confirmations are sent within 24–48 hours after payment.
6) Authorized Email Only
- Delivery and download authorization are issued only to the purchaser’s email on file.
- To update your email, contact love@elopestx.com before fulfillment.
7) Download Access Window & Limits (Own + Access)
- Download links remain active for 7 days and allow up to two (2) downloads per gallery.
- After expiry or when limits are reached, re-delivery (if available) follows current pricing.
8) Image Specifications
- High-resolution JPEGs, sized 8×12 inches at 300 dpi. (RAW files are not included.)
9) Scope of Storage
- Storage applies to your existing gallery for the covered event and term. It maintains online viewing/sharing/print ordering; it is not a lifetime backup of files.
10) Deadline & Removal
- If no purchase is made by October 31, 2025 (11:59 PM AST), your gallery will be removed from our servers. After removal, recovery may not be possible.
11) Account Access, Passwords & Link Sharing
- Gallery credentials and download links are issued to the purchaser’s verified email and are non-transferable. Sharing, posting, or redistributing passwords or download links is prohibited and may suspend or remove access without refund. Download limits are enforced; shared links can exhaust your allowed downloads or trigger security flags that interrupt delivery. If others need access, they can purchase this product during this promotion.
12) Taxes & Fees
- Applicable taxes and/or payment-processor fees may be added at checkout.
13) Data Backup
- We strongly recommend backing up delivered files in at least two locations (e.g., local drive + cloud). We cannot replace lost files after successful delivery.
14) Non-Transferable
- Purchases are tied to the purchaser and event and are not transferable.
15) Refund Policy
- All sales are final. For support, contact love@elopestx.com.
16) Representations & Authority
You represent that you are the purchaser of record (or authorized representative) for the gallery/event and that any information you provide to us (including your email) is accurate and current. You are responsible for any access you grant to others.
17) Indemnification
You agree to defend, indemnify, and hold harmless Q Studio, LLC, its owners, employees, and contractors from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees)arising out of or related to: (a) your breach of these Terms; (b) any access you grant to third parties (including shared passwords or links); (c) disputes among you and any third party about receipt, access, or use of the images or our communications; (d) your use or distribution of the images; (e) chargebacks or payment disputes initiated by you or an authorized user; and (f) the inaccuracy of information you provide. This obligation survives gallery removal and completion of services.
18) Limitation of Liability
To the fullest extent permitted by law, Q Studio, LLC’s total liability for any claim related to these services will not exceed the amount you paid for the specific product at issue in the 12 months before the event giving rise to the claim. We are not liable for incidental, consequential, special, indirect, or punitive damages (including lost profits, emotional distress, or lost data), even if advised of the possibility.
19) Sensitive Communications & Opt-Out
We recognize these images may relate to meaningful life events. If you prefer not to receive reminders about a gallery, use the email unsubscribe link or contact love@elopestx.com with the subject “Opt-out — Gallery [Event Date/Name]” and we’ll stop outreach about this gallery. Opting out will not affect your ability to purchase during the promotion if you contact us, nor your ability to receive download links to the purchaser’s verified email.
20) Deceased or Disputed Accounts
If the purchaser of record is deceased or there is a legal dispute about access, we will communicate with the executor/personal representative upon receipt of reasonable documentation. Until then, we can communicate only with the purchaser of record. Deadlines (including removal dates) may still apply.
Governing Law & Venue
These Terms are governed by the laws of the U.S. Virgin Islands. Any disputes will be brought in the courts located in St. Thomas, USVI.
Changes to Terms
We may update these Terms from time to time. The “Effective Date” at the top will change. Your purchase after an update constitutes acceptance of the revised Terms.
Notices & Electronic Communications
You consent to receive all notices electronically at the purchaser’s email on file. Delivery is deemed given when sent, even if filtered to spam or otherwise not received.
Force Majeure & Third-Party Platforms
We are not responsible for delays or failures caused by events beyond our control or by third-party platforms (e.g., PayPal, Pixieset) including outages, policy changes, or service interruptions.
Price Changes & Promotional Limits
Promotions are time-limited and subject to change. Limit one of each product per customer per gallery/event. Offers may be withdrawn or modified at any time before purchase.
Auto-Renew Courtesy Reminders
As a courtesy, we may send renewal reminders (e.g., 7 days prior), but reminders are not guaranteed. Renewal occurs on the purchase anniversary (timezone: America/St_Thomas).
Chargebacks
If you initiate a chargeback contrary to these Terms, we may suspend access and charge a reasonable administrative fee to reinstate services, if available.
Identity Verification
To protect client privacy, we may require proof of identity and/or event details to make changes to the purchaser’s email, grant access, or re-deliver files.
Data Retention After Removal
Once a gallery is removed, files are purged from active systems. We do not guarantee archive retention or recovery after removal.
Age & Authority
You represent that you are at least 18 years old and authorized to purchase for this gallery/event.
Accessibility & Alternate Delivery (optional)
If you need reasonable accommodations to access downloads, email love@elopestx.com and we will provide an alternate delivery method where feasible.
Entire Agreement; Severability
These Terms constitute the entire agreement for the products described. If any provision is unenforceable, the remaining provisions remain in effect.

Headings are for convenience only and do not affect interpretation.
